Kenneth Jerome James appeals his convictions for second degree theft and third degree assault. The charges arose when James exited a Kmart store without paying for goods and store personnel detained him. He refused a pat-down search while waiting for police and attempted to flee when store personnel told him that he would be handcuffed while awaiting police. A struggle ensued and James bit store employees and received some injuries to his face. Three issues are raised and each is meritless:
